법무부에서 고용 차별에 대해 SpaceX를 조사중............................

The U.S. Department of Justice is investigating SpaceX over whether the company discriminates against non-U.S. citizens in its hiring practices and said Elon Musk’s company is stonewalling a subpoena for information, court documents revealed Thursday.

The DOJ’s Immigrant and Employee Rights Section received a complaint of employment discrimination from a non-U.S. citizen claiming that the company discriminated against him based on his citizenship status.

미국 법무부는 SpaceX가 미국인이 아닌 사람들에 대해 고용단계에서 차별을 하는지 에 대해 조사중이다. SpaceX 는 정보를 얻기 위한 소환장을 거부하고 있다고... 

법무부의 이민, 고용권 섹션은 SpaceX 가 시민권 상태에 기반하여 사람을 고용차별하고 있다는 주장을 미국인이 아닌 사람으로부터 받았다고 한다. 

 

“The charge alleges that on or about March 10, 2020, during the Charging Party’s interview for the position of Technology Strategy Associate, SpaceX made inquiries about his citizenship status and ultimately failed to hire him for the position because he is not a U.S. citizen or lawful permanent resident,” DOJ attorney Lisa Sandoval wrote in a complaint filed Thursday.

SpaceX did not immediately respond to CNBC’s request for comment. The Department of Justice declined to comment.

"이 고발건은 2020년 3월 10일쯤, (한 남성이) 기술전략부의 포지션을 위한 Charging Party's 인터뷰 동안에 SpaceX가 그의 시민권에 대해 질문을 했고, 그가 미국 시민이 아니고 법적으로 영구거주가능한 상황이 아니었기 때문에 그 포지션에 결국 고용하지 않았다고 주장한다." 

SpaceX는 즉각적으로 CNBC의 코멘트요청에 대답하지 않았다. 법무부는 코멘트하길 거절했다.

 

The Immigrant and Employee Rights Section, or IER, said it notified SpaceX via email on June 8 that it had opened an investigation, requesting SpaceX provide information and documents related to its hiring and employment eligibility verification processes.

The complaint said SpaceX responded in August, sending the DOJ a Form I-9 spreadsheet of information about employees dating back to June 2019. But SpaceX refused the DOJ’s request “to produce any Form I-9 supporting documentation, such as copies of employees’ passports, driver’s licenses, or Social Security cards,” Sandoval wrote.

IER then obtained a subpoena on Oct. 7, but SpaceX refused to produce the subpoenaed documents, the complaint said.

IER은 6월 8일에 이메일을 통해 SpaceX 에 조사를 시행했고, 고용 적격 확인 절차와 관련된 정보나 서류를 제출하길 요구하고 있다고 했다. SpaceX 가 8월에 법무부에 2019년 6월까지의 직원과 관련된 정보의 Fom I-9를 보내며 대응을 했다고 했다. 하지만 SpaceX는 법무부가 "SSC나 운전면허, 직원 여권 카피와 같은 Form I-9를 서포트할만한 걸 제출하라는 요청에는 거절했다고 한다. IER 은 10월 7일 소환장을 얻었지만 SpaceX는 서류를 제공하길 거부했다고...

 

SpaceX filed a petition with a DOJ administrative tribunal to dismiss the subpoena on grounds that it exceeded the scope of IER’s authority, but that petition was denied, and SpaceX was ordered to comply. IER said SpaceX on Dec. 11 acknowledged the order but told IER “that it ‘does not intend to produce any additional information in response to the administrative subpoena.’”

The IER argued that the subpoenaed documents are relevant because they would show the extent to which SpaceX hires non-U.S. citizens, and that it’s not a burdensome request, although SpaceX has told the IER that it would have to retrieve each document manually.

The Department of Justice is requesting an order from the court to require SpaceX to comply with the subpoena within two weeks.

SpaceX 는 법무부 행정법원에 IER 의 권한을 넘어선 일이라는 근거로 소환장을 기각해달라는 청원을 제기했다. 하지만 그 청원은 거절되었고, SpaceX는 이에 응해야 되었다. SpaceX가 12월 11일 명령사항을 인정했지만 IER 측에 "행정 소환장에 대응하여 IER에 어떤 추가 정보를 제공할 의도는 없음을 말했다.

IER은 소환서류는 SpaceX가 미국 시민이 아닌 사람을 어느정도로 고용하는지 보여줄 것이고, 각 서류마다 손으로 찾아봐야 되더라도 많이 부담되는 요청도 아니기 때문에 의의가 있다고 주장했다. 

법무부는 2주내로 SpaceX가 응하기를 요구하는 법원 명령을 요청하고 있다.

*개인적으로 제품 결함같은 소식이 낫지, 뭔가 윤리적인 문제가 있는게 더 싫다 나는... ^^ CNBC 에서만 보이고 다른 커뮤니티 같은곳에선 한번도 회자되지 않아서 가져와 봤는데, 별일 아니었으면 좋겠다. SpaceX 가 따로 상장되어 있질 않으니 얘가 잘못있어도 테슬라도 출렁이잖아요... ^^ 그리고 기업윤리가 중요한 미국에서 이런문제는 좀 더 민감하게 바라봐야 될것으로 보인다.
